Open functions

Prediki's design strives for providing large parts of functionality as a free and open platform, aiming to facilitate broad participation with minimal hurdles. All non-confidential content can be viewed without registration. Many functions can be performed by unregistered Visitors, or flagged as anonymous when performed by logged-in Users. Open functions include creating and modifying questions, authoring and editing analysis articles, writing and commenting messages. Visitors performing such actions should know that they are identified by their IP addresses.

Data collection for restricted functions

For the performance of other functions, Prediki collects personal information on a need-to-know basis. The provision of some personal information is optional. If you do not provide us with optional information, you may be unable to utilise the full functionality of the Site or to avail yourself of all Services.

We request personal information during the registration process and in the course of your use of Prediki, e.g. when sponsoring incentives or when entering non-disclosure obligations for Confidential Questions. Collection occurs if you input any personal information into the Site or provide it to us in any other way, such as through e-mail.

We are not responsible for any personal information you choose to contribute publicly. If you voluntarily provide information in publicly accessible areas of the Site, such as your public profile, messages and articles, the information can be viewed and therefore used by others. We advise Users not to disclose personal information that they do not wish to have publicly available.

Purpose

Besides for providing you with the Services and a convenient experience on the Site, Prediki uses personal information for purposes such as the compilation of usage statistics, or the discovery, investigation and solution of technical problems.

As a predominantly free and open platform, Prediki is inherently subject to various risks and will fend off abusive practices also by using personal information, such as attributing actions to certain Users, identifying manipulators, preventing vandalism and disturbances, uncovering abusive double registrations, and ensuring respectful behaviour.

Cookies

Prediki uses cookies essential to the proper running of the Site. If you do not agree to the usage of these essential cookies, then you should not use the Site and Services. Prediki also offers Users a non-essential permanent cookie for automatic log-in with personal devices which you may enable or disable with a checkbox during log-in.

Disclosure

We disclose personal information only to our contracted service providers who assist us in operating the Site and in providing the Services. We will never disclose personal information to an unrelated third party without your consent.

Apart from ordinary business, we may disclose personal information in special situations where we have reason to believe that doing so is necessary to identify, contact or bring legal action against anyone damaging, injuring or interfering (intentionally or unintentionally) with our rights or property, our users or anyone else who could be harmed by such activities.

We may also disclose personal information upon a lawful request by an authority or another third party as required by Austrian law. Where Prediki is requested by any third party to access data under a prima facie lawful request which however might be based on a violation of Human Rights, Prediki will, where it determines in its sole discretion to do so, challenge the request in any legal or political manner it deems appropriate.

Notice and take-down

If you believe that your personal information has been disclosed publicly illegally by any person other than yourself and are unable to rectify this yourself with the Site’s editing functions, please contact us immediately. In doing so, please provide us with a notice containing the following information:

  1. your name, address, and electronic signature or other legal proof of identity;
  2. the offending personal information and its location on the Site;
  3. a statement that there is no legal basis for the public disclosure of your personal information;
  4. a statement that this notice is accurate and, under the penalty of perjury, you are authorised to issue this notice.

Retention of information

We retain information for as long as legally required, or useful and legally allowed, but do not undertake retention obligations. We may delete or purge information at our discretion and without notice, subject to applicable legal obligations regarding the retention of information. You must keep your own, separate back-up records if you wish to ensure retention.

User data deletion

If you wish to delete you user data, you can cancel you user account on your profile settings page. You can also change or erase specific user data items.

Security

Prediki’s processes ensure the security of your personal information and credentials, including authentication, access control, encryption and backup systems. We have physical, electronic, and managerial procedures to help safeguard and prevent unauthorised access, maintain data security, and protect the use of your personal information.

However, neither people nor security systems are infallible. While we use reasonable efforts to protect your personal information, we cannot guarantee its absolute security or error-free processes at all times. Despite our efforts, third parties, organisations or foreign governments with advanced technical capabilities (such as data mining, hacking, etc.) could be able to obtain and use personal data illicitly.

You must do what you reasonably can to ensure the security of your personal information. It is your obligation that you protect yourself against unauthorised access to your password and to your device. Please log out of the Site when you have finished using a shared device. Be wary of including sensitive information in your e-mails to us as they are not necessarily secure against interception. We will never ask for passwords in an e-mail and you should assume that any such request must be fraudulent phishing.

Hosting

Prediki is headquartered in the Republic of Austria but the Site is hosted in the Federal Republic of Germany. For that reason, Prediki transfers all data including personal information to our hosting service provider who is subject to German laws. You hereby consent to this transfer.

Changes to the Policy

We reserve the right to amend this Policy at any time. Changes and clarifications will take effect immediately. If we make a significant change to the Policy, we may issue a notice by e-mail or through notice on the Site. We encourage you to check the Policy from time to time to check for changes or to use the "subscribe" function.

This Policy complies with and is subject to the mandatory provisions of the Austrian Data Protection Law and the Austrian Telecommunications Act which shall prevail in the case of a conflict. For further legal information please refer to www.ris.gv.at, www.dsk.gv.at and www.rtr.at.
